These Terms of Service (the "Terms") govern your access to and use of the DailyMoments mobile application and related services (collectively, the "App"). By installing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. If you are under 18, you represent that you have obtained consent from a parent or legal guardian.
Subject to these Terms, we grant you a personal, limited, non‑exclusive, non‑transferable, revocable license to install and use the App on a device that you own or control.
You agree not to: (a) reverse engineer, decompile, or disassemble the App; (b) copy, modify, or create derivative works of the App; (c) interfere with or disrupt the App or its servers; (d) use the App in violation of any law or third‑party rights.
The App enables creation and storage of voice recordings. You retain all rights to your content. You are responsible for the content you record and for complying with applicable laws. The App stores voice notes locally on your device.
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the practices described there.
Apple Sign In is optional and only required when you choose to share moments. Your Apple User ID is stored locally on your device only.
The App and its original content, features, and functionality are owned by the App's publisher and are protected by intellectual property laws. All rights not expressly granted are reserved.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR‑FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App or your violation of these Terms.
We may modify or discontinue the App (in whole or in part) at any time. We may update these Terms from time to time; the "Last updated" date reflects the latest changes. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful.
These Terms shall be governed by and construed in accordance with the laws applicable in your place of residence, without regard to conflict‑of‑law principles, unless otherwise required by the laws of your jurisdiction.
